Terms of Service

1. Acceptance of Terms
By accessing or using seconddns.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Service
We provide a secondary DNS hosting service that synchronizes DNS zone data from your primary nameserver via AXFR zone transfers. The Service acts as a secondary authoritative nameserver for your domains.
We offer both free trial and paid subscription plans. Features and limits vary by plan as described on the Pricing page.
3. Account Registration
To use the Service, you must create an account by providing a valid email address and password. You are responsible for:
– Maintaining the confidentiality of your account credentials – All activity that occurs under your account – Notifying us immediately of any unauthorized use of your account
You must be at least 16 years old to create an account. By registering, you represent that all information you provide is accurate and complete.
4. Free Trial
New accounts receive a 3-month free trial with access to the Free plan features. No credit card is required to start the trial.
After the trial period ends, you have 7 days to select a paid plan. If no plan is selected within this time:
– DNS zones are deleted from our infrastructure – The account is suspended and stops serving DNS queries – The account itself is retained until you select a paid plan or request account deletion
5. Paid Plans and Billing
Paid subscriptions are billed on a monthly or annual basis, as selected at the time of purchase. Fees are stated in the currency shown at checkout. Refunds are governed by our Refund Policy, which includes a 30-day money-back guarantee on first payments.
Prices displayed on the Pricing page exclude tax. Applicable VAT or similar taxes are added at checkout based on your billing address and shown before payment confirmation. For transactions processed by Paddle (acting as Merchant of Record), VAT is collected and remitted by Paddle in accordance with applicable EU and local tax regulations.
We use third-party payment processors (including Paddle, which acts as the Merchant of Record for card payments) to handle billing. Your full payment information is not stored on our servers.
We reserve the right to change pricing at any time. Price changes will be communicated at least 30 days in advance and will take effect at the next renewal cycle.
If a payment fails, you will have 7 days to update your payment method, after which your account will be blocked.
6. Acceptable Use
You agree not to use the Service to:
– Violate any applicable law or regulation – Infringe on the intellectual property rights of others – Distribute malware, spam, or any harmful content via DNS records – Attempt to gain unauthorized access to any part of the Service or its infrastructure – Use the Service in a way that interferes with or disrupts the Service for other users – Resell or sublicense access to the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
7. DNS Zone Data
By adding a DNS zone to the Service, you represent that you have the right to manage and publish that zone. You retain ownership of all DNS zone data you provide.
You grant us a limited right to store, process, and serve your DNS zone data solely for the purpose of providing the Service.
We do not modify your DNS records except as part of the AXFR synchronization process. We are not responsible for errors originating from your primary nameserver.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.
We are not liable for any downtime, data loss, or damages resulting from:
– Planned or unplanned maintenance – Failures of third-party infrastructure providers – Events beyond our reasonable control (force majeure) – Misconfiguration on your primary nameserver
9. Intellectual Property
The Service, including its software, design, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.
11. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) that may arise from:
– Your use of the Service – Your violation of these Terms – Your violation of any third-party rights – DNS zone data you submit to the Service
13. Termination
You may close your account at any time in your account settings. Upon service termination:
– DNS zone synchronization will stop immediately – Your zone data will be deleted immediately – Prepaid subscription fees are refunded according to our Refund Policy
We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our sole discretion. We will make reasonable efforts to notify you before termination except in cases of serious violations.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without prejudice to mandatory consumer protection rules of the European Union and the country of residence of the consumer.
Any disputes arising from or related to these Terms or the Service shall first be resolved through good-faith negotiation. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
If negotiation and online dispute resolution fail, disputes shall be subject to the jurisdiction of the competent Polish courts, without prejudice to mandatory consumer jurisdiction rules.
